Terms of Sale - Highlights

The following highlights key sale terms and identifies sale specific terms. These, along with our General Terms & Conditions of Sale comprise the Complete Terms of Sale. To confirm your responsibilities as a buyer, please review the items below and view or download the General Terms & Conditions of Sale.

 

  • INSPECTION: No inspection is offered for this sale, as all items are in storage vaults and have been rewrapped and returned to storage pending the sale.
  • BIDDING: All items have a minimum opening bid amount. Should you bid this amount and no one increases the bid, you will be the winning bidder. Bidding occurs per the increment table accessible on the Live Auctioneers website or at the discretion of the Auctioneer, who may lower or raise opening bids or increments during the auction.
  • QUANTITIES: Please note that some lots may have multiple pieces. The bid price you submit will be a lump sum for the entire lot, inclusive the entire quantity described.
  • BUYER’S PREMIUM: A 25% Buyer’s Premium will be added to the price of each item. 
  • SHIPPING: We do NOT provide shipping services.  See PICKUP/REMOVAL below for more details, as well as our list of UNAFFILIATED 3RD PARTY SHIPPERS listed below.
  • PAYMENT DEADLINE: All payments are due upon receipt of invoice;  You will have the opportunity to select credit card or ACH payment when you receive your invoice. If you do not select an option within 72 hours, your card on file will be charged; Balances over $10,000 must be paid by wire transfer or ACH within 72 hours.
  • REPRESENTATIONS: We do our best to provide information that will help Buyers to make purchase decisions, including indicating damage on items where known; however we do not guarantee descriptions or conditions. Further, neither Auctioneer or Seller makes any representation, guarantee or warranty as to the provenance or authenticity of any items offered for sale.  If you are uncertain about an item, do not bid. This sale is taking place under court authority, and as such, all Items are sold ‘As-Is, Where-Is’, with all faults and without recourse. Buyer assumes all risks, and all sales are final.
  • PICKUP/REMOVAL:  Shipping is NOT provided by Auctioneer or Seller. Paid Buyers may pickup their purchases from the product locations in Chatsworth or Sylmar, California, as noted on each lot, or make arrangements for items to be shipped using your own contracted Shipper. Buyer is responsible for all costs and coordination regarding packaging, handling, shipping and insurance. You may use your own shipper or refer to our list of 3rd Party Shipping Referrals below. Item removal must be scheduled in advance by contacting of offices at [email protected] or calling 805.496.8087, option 3.  

    We are scheduling appointments for the following dates/times:

    • Lots 101-122: Monday, August 15 thru Tuesday, August 16, from 9am to 4pm
      Sylmar Storage Facility – 12353 Foothill Blvd, Sylmar, CA 91342

    • Lots 201-302: Wednesday, August 17 thru Friday, August 19, from 9am to 4pm
      Chatsworth Storage Facility – 8929 Oso Ave., Chatsworth, CA 91311

    Important Pickup Information:  Please note specific pickup location for your lots.  You will need to arrive with a copy of your Invoice and an ID matching the name on the invoice.  If a 3rd Party will be picking up on your behalf you will need to complete an Agent Release form and provide it to the office prior to pickup. Storage facilities will load your purchases onto your vehicle. Certain items may be blanket wrapped at pickup.  These blankets belong to the storage facility but may be purchased directly from the storage facility for $20 per blanket or replaced with your own.  The storage facilities are listed amongst the 3rd Party Shippers and may be able to assist with moving your purchases within California.  See 3rd Party Shippers for more details.

  • SALES TAX: Determination of eligibility for Sales Tax exemption resides with LiveAuctioneers, unless payment is made by wire transfer directly to ThreeSixty.  If paying thru LiveAuctioneers, you MUST update your forms in your LiveAuctioneers profile before the conclusion of the auction.  If paying by wire transfer, you will need to submit a California Reseller Exemption form and a copy of your valid certificate to [email protected] prior to the close of the auction. In each case, either LiveAuctioneers or ThreeSixty shall reserve the right to reject a buyer’s form of exemption if either party deems the form of exemption as unacceptable.  In such case, applicable sales tax will be due and payable as part of the purchase transaction.DEPOSITS/DEFAULTS: We will verify your credit card upon Auction Registration and reserve the right to secure a deposit equal to 25% of your total high bids. Upon award of bid, Buyers are deemed responsible for a non-refundable 25% deposit, whether or not Auctioneer elects to collect it.  In the event of a Buyer default, Buyer’s acceptance of these Terms of Sale, evidenced by their participation in the auction, shall serve as Buyer’s authorization for Auctioneer to pursue whatever means necessary to collect upon the 25% deposit as liquidated damages, including charging its credit card on file.  In addition to the collection or retention of Buyer’s deposit, Auctioneer may report Buyer’s failure to perform on its obligations to the LiveAuctioneers rating system impacting Buyer’s ability to participate in future LIveAuctioneers auctions.

Payments

  • All payments are due upon receipt of Invoice, which will be emailed within 24 hours of the auction.

  • You will find a “Pay Now” option on the invoice which will allow you to pay by credit card or ACH bank payment. These options only apply to purchases under $10,000.

  • If you spend in excess of $10,000, we require payment in the form of a wire transfer or ACH.

  • If you have not submitted payment or contacted us to arrange payment within 3 days of the time that the invoice is sent, we will charge the credit card you used to register for the auction for the full amount listed on your invoice (or a maximum of $10,000 pending the balance by wire transfer if applicable).

  • Once you have paid, you will receive a paid invoice by email and may arrange for pickup of your purchases.

  • Buyers paying by wire transfer must contact our office for wire transfer instructions at 805-496-8087, ext. 110.

  • Payments are not accepted at the Auction Site;

What to Bring to Pickup: 

  • Materials to pack and/or wrap your items (many items are wrapped with storage company blankets, which must be replaced or purchased from the storage company for $20 each)
  • A printed copy of your invoice
  • ID which matches the name on the invoice
  • If sending a 3rd party to pickup on your behalf, you must complete and submit an Agent Release form to our office authorizing the 3rd party to pickup on your behalf.  The 3rd party must provide ID matching the Agent Release form and sign documentation upon arrival at pickup.
